1. Accuracy of Tender Information

Tender notices listed on Bidnexis are sourced from publicly available procurement portals, official government gazettes, newspapers, and partner publishers. While we make reasonable efforts to ensure accuracy and completeness, we cannot guarantee that every listing reflects the most current version of a tender notice.

Procuring entities frequently issue addenda, extend deadlines, change submission addresses, or cancel tenders without prior notice. Bidnexis may not reflect these changes immediately. You are responsible for:

  • Downloading the original tender documents directly from the issuing entity or official portal.
  • Confirming the current closing date and submission requirements before preparing a bid.
  • Attending any mandatory pre-bid meetings that may have been added or rescheduled.
  • Verifying that a tender has not been cancelled, suspended, or re-advertised.

2. AI-Generated Content (VERA)

Bidnexis uses Google Gemini, an AI language model, to power several features including:

  • VERA bid intelligence — bid writing suggestions, compliance checks, strategy advice
  • Tender extraction — converting uploaded documents into structured data
  • Multi-lot identification — detecting individual items within a tender advert
  • Document verification — checking whether uploaded files match their claimed category
  • AI tender alerts — generating summaries of new opportunities
AI outputs are suggestions, not professional advice. VERA may produce content that is inaccurate, incomplete, outdated, or inappropriate for your specific situation. AI-generated bid content should always be reviewed, edited, and verified by a qualified professional before submission to any procuring entity.

Specifically regarding AI features:

  • Bid writing: Generated bid text is a starting point, not a finished submission. Requirements, pricing, and technical specifics must be verified by you.
  • Multi-lot extraction: The AI attempts to identify individual lots or line items within a tender advert but may miss some or misclassify others. Always review the full original document.
  • Document matching: The AI's assessment of whether your vault documents qualify you for a tender is indicative only. Eligibility decisions rest with the procuring entity.
  • Compliance checks: A "pass" from VERA does not guarantee your bid will be accepted as compliant by the evaluating committee.
  • Win probability scores: These are statistical indicators based on available data — not predictions of outcome.

We are not liable for bid disqualification, lost contracts, or financial losses resulting from reliance on AI-generated content.

3. Document Vault & AI Matching

The Document Vault allows you to upload compliance documents — tax clearances, registration certificates, financial statements, and similar — so that VERA can match them against tender requirements automatically. This matching is AI-driven and operates as follows:

  • The AI reads the requirements of a tender and cross-references the document types you have uploaded.
  • It flags which required documents appear to be present, which are missing, and which may be expired.
  • It does not read the content of your uploaded documents to verify accuracy — it relies on the metadata (document type, label, expiry date) you provide.

The vault matching is a checklist aid — it does not constitute a legal or procurement compliance review. The procuring entity's evaluation panel will review your actual submitted documents, and their assessment is final.

4. No Legal or Professional Advice

Nothing on Bidnexis — including content generated by VERA, articles in our academy, blog posts, or notifications — constitutes legal, financial, tax, or procurement advisory services. All content is for informational and general guidance purposes only.

If you need advice specific to a procurement dispute, bid challenge, contract interpretation, or regulatory compliance matter, you should engage a qualified procurement lawyer or certified procurement professional.

5. Third-Party Links and Sources

Bidnexis may link to or embed content from third-party procurement portals, government websites, and partner publishers. We do not control, endorse, or take responsibility for content on external websites. Links are provided for convenience — always verify the source before relying on external content.

Payment processing is handled by Flutterwave and M-Pesa. Their terms and data practices govern payment transactions. Bidnexis does not store card details and is not responsible for errors that occur within third-party payment systems.

6. Platform Availability

We aim to keep Bidnexis available around the clock, but we cannot guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, server issues, third-party API outages (including the AI service), or events outside our control.

We are not liable for missed tender deadlines, lost data, or other losses resulting from platform downtime. We strongly recommend downloading tender documents and saving important information locally — do not rely solely on Bidnexis as your only record of a tender opportunity.

7. Jurisdiction and Governing Law

This disclaimer, together with our Terms of Service and Privacy Policy, is governed by the laws of the Republic of Kenya. Bidnexis is operated from Nairobi, Kenya.

While we serve users across Africa and beyond, we make no representation that the platform complies with procurement regulations in every jurisdiction. Users are responsible for ensuring their use of the platform complies with local laws in their respective country.

8. Fraud Prevention & Due Diligence

Bidnexis is not liable for fraud, scams, or financial losses arising from tenders or entities listed on this platform. You must independently verify every opportunity before committing funds, sharing sensitive information, or submitting a bid.

Procurement fraud is a serious and growing risk across African markets. Bidnexis aggregates tender listings from a wide range of sources but cannot guarantee the legitimacy of every listing or every advertiser on the platform. We apply verification processes to companies and advertisers, but no automated or manual system is foolproof.

Common procurement fraud patterns to watch for:

  • Advance fee fraud: You are asked to pay a fee — registration, processing, document access, or mobilisation — before work has been awarded or a contract signed. Legitimate procuring entities do not require upfront payments from bidders.
  • Fake tender notices: Fraudulent entities post fabricated tenders to collect bid bonds, qualification fees, or personal information from suppliers. Always verify the issuing entity exists and is actively registered.
  • Impersonation of government bodies: Fraudsters use official-sounding names, logos, and letterheads to deceive suppliers into paying fees or submitting documents to fake portals.
  • False award letters: A supplier receives a fake "Letter of Award" or "Intent to Award" demanding performance bond payment before a formal contract is signed. Verify directly with the procuring entity using contact details from their official website — not those in the letter.
  • Inflated or fictitious bid documents: Documents requiring specialised, expensive certifications that serve no procurement purpose, designed to extract fees from consultants or certifying bodies.
  • Payment interception: After a contract is awarded, a fraudster poses as the supplier and requests that payments be redirected to a different account. Always verify banking details through a secondary, independently verified channel.

Your due diligence responsibilities:

  • Verify the procuring entity's registration and legal existence through your country's official company registry or government directory.
  • Cross-reference the tender notice on the procuring entity's official website or official government procurement portal — not just on aggregator platforms like Bidnexis.
  • Never pay any fee to access tender documents unless you have independently confirmed this is standard practice for that specific entity and that the payment instruction matches official contact channels.
  • Do not share company bank details, tax PIN, or sensitive credentials in response to unsolicited emails claiming to represent a procuring entity.
  • If you suspect a fraudulent tender listing on Bidnexis, report it to us immediately.

  • Financial losses resulting from procurement fraud, scams, or misrepresentation by third parties encountered through the platform
  • Errors, inaccuracies, or omissions in tender listings, AI-generated content, or platform data
  • Platform downtime, data loss, or service interruptions
  • Actions or omissions of procuring entities, advertisers, or other platform users

Your use of Bidnexis is entirely at your own risk. This limitation of liability applies whether the claim arises in contract, tort, negligence, or any other legal theory.
